Terms of sale and service

Terms governing registration, purchase and use of the VisiblyWeb service.

1. Scope and definitions

These terms govern the creation of a VisiblyWeb account and the purchase and use of the accessibility widget and related services (the “Service”) supplied by Antherica S.r.l. (“Antherica”). The customer is the person or organisation identified during registration and checkout. The “Domain” is the website hostname associated with a licence.

2. Account and conclusion of the contract

The customer must provide accurate, complete and up-to-date information, keep credentials confidential and promptly report unauthorised use. Registration creates an account but does not by itself purchase a paid licence. The sales contract is concluded when the payment is successfully authorised and Antherica confirms the order electronically. The customer can review the selected plan, Domain, price and payment method before submitting the order.

3. Plans, prices and duration

The annual Accessibility licence costs €99. Translate can be added for €20, Audio Description for €40, or both modules together for a total annual price of €149. Each licence applies to one Domain and includes the annual widget-view allowance shown during configuration and checkout (120,000 views by default). Taxes and the final payable total are displayed before payment. Unless an automatic renewal option is expressly offered and selected, the licence does not renew automatically and expires twelve months after activation.

4. Annual view limit

A view is normally counted when the widget loader is validly requested on the licensed Domain; reasonable technical filtering may exclude known bots, retries and Antherica monitoring. Usage is aggregated by calendar day and compared with the annual allowance assigned to the Domain. If that allowance is exceeded, Antherica may contact the customer to agree additional capacity and, after reasonable notice, may limit delivery; urgent limits remain possible for abusive or security-threatening traffic.

5. Activation, installation and support

After payment confirmation, the licence is activated and the customer receives installation code for the Domain. The customer is responsible for installing it correctly, testing it on the website and maintaining compatible site code. Updates and ordinary email support are included for the licence term. Availability may be interrupted for maintenance, security work or circumstances outside Antherica’s reasonable control.

6. Accessibility, translation and audio description

VisiblyWeb provides tools that visitors can use to adapt their browsing experience. It supports, but does not by itself certify or guarantee, compliance of the customer’s website with accessibility laws or technical standards. Compliance also depends on content, code, design, editorial processes and third-party components under the customer’s control. Translate and Audio Description use automated processing: the customer must review material results and remains responsible for published content and any sector-specific accuracy requirements.

7. Permitted use

The customer receives a limited, non-exclusive and non-transferable right to use the Service on the licensed Domain for the paid term. The customer must not circumvent licence or usage controls, reverse engineer or resell the Service, use it unlawfully, interfere with its operation or introduce malicious code. Antherica may suspend access where reasonably necessary to protect security, comply with law or address a material breach, providing notice where practicable.

8. Payments and invoices

Payments are processed through Nexi or PayPal under the chosen provider’s terms. Payment-card or PayPal credentials are entered on the provider’s systems and are not stored by this website. Antherica issues the applicable tax document using the billing information supplied by the customer.

9. Consumer withdrawal

A customer acting as a consumer may withdraw from a distance contract within 14 days from its conclusion, without giving a reason, by sending an unequivocal statement to visiblyweb@antherica.com. If the consumer expressly requests immediate performance during that period and later withdraws before the Service has been fully performed, the consumer may owe an amount proportionate to the Service already supplied. Once the Service has been fully performed, the right may be lost only where the conditions and acknowledgements required by applicable law have been met. Mandatory consumer rights remain unaffected.

10. Intellectual property

The Service, software, interface, documentation, trade marks and installation code remain the property of Antherica or its licensors. The customer retains rights in its website, content and configuration data.

11. Data and privacy

Personal data relating to the account, orders and support is processed under the applicable privacy notice. The customer must ensure that installation and use of the widget on its Domain comply with its own privacy, cookie and information obligations, including for any third-party services it enables.

12. Liability

Each party is liable under applicable law. To the fullest extent permitted, Antherica is not liable for indirect or consequential losses, loss of profit or damage caused by the customer’s website, incorrect installation, third-party services, unlawful content or events outside its reasonable control. Nothing in these terms excludes liability that cannot legally be excluded, including mandatory consumer protection.

13. Changes and termination

Antherica may update the Service for security, legal or technical reasons. Material changes to these terms apply to future purchases or renewals and will be made available before acceptance; changes required by law or necessary to prevent abuse may apply earlier with appropriate notice. Either party may terminate for a material breach not remedied after reasonable notice, without prejudice to accrued rights.

14. Governing law and disputes

Italian law applies. For consumers, mandatory protections and the court of the consumer’s place of residence or domicile remain applicable. For customers acting in the course of business, the Court of Reggio Emilia has exclusive jurisdiction, unless mandatory law provides otherwise. Before starting proceedings, customers are invited to contact Antherica so the matter can be addressed promptly.
